I don't even know my rites in this matter and every one I have called just wants to consolidate my debt, for a small fee.

First thing, did you actualy recieve a court summons? if so, it should indicate the court, address, date of hearing and docket number. If this information is there, then call the court to verify it. Next, check to see if they can sue you. Each state has a differednt time period in which to take you to court, this is called the states "statute of limitations" (SOL)

If the debt is time barred meaning too late to take you to court, then that would be your defense and they would not get anything.
If it is not time barred, you can try to work out some payment plan and IF they offer arbitration, stay away, that is like going to court only it always works in their favor. You must remember that if it is the original credit card company then the FDCPA does not apply to them.
Get your credit report to see if they charged off the account. If they did, then you may be dealing with a third party collection agency which changes the rules of the game.

You can't just stop paying on loans without unhappy consequences.
Is the $1300 the same $1300 you're being sued for ? If so, you need to contact the credit card company, explain your situation, and hope they're willing to work with you. Forget the consolidators - you don't need them.
